Because of the positive experiences with mediation in the USA, the “EU Directive 2008/52 / EC on certain aspects of mediation in civil and commercial matters” was issued on 21.05.2008.
This EU Directive was implemented in Germany by the “Law for the Promotion of Mediation and other Out-of-court Conflict Resolution Procedures” (MediationsG) of 26.07.2012.
The main objectives of the German law and the European directive are:
- Promoting mediation and access to mediation in international disputes,
- Creating a uniform professional law and thus assuring quality,
- Unification of (legal) definitions.
